Terms and Conditions of Sale and Delivery (TCS)
These TCS apply to all deliveries from Dioib SAS to private consumers (B2C).
They apply in the absence of any other written agreement between Dioib SAS and the buyer.
1. PLACING ORDERS
Before submitting your order, please carefully review your order, payment, delivery and billing information.
Shortly after placing your order, you will receive an acknowledgement email confirming receipt of your order. Please note that this acknowledgement does not constitute an order confirmation and does not bind Dioib SAS at that stage. A binding contract between you and Dioib SAS is only concluded when we send you an email confirming that your order has been shipped.
We reserve the right to refuse your order if, for example, we are unable to obtain payment authorization, if shipping restrictions apply to a given product, if the item ordered is out of stock or withdrawn for quality‑control reasons, or if you do not meet any eligibility criteria listed in these Terms.
We may also refuse to process or cancel any transaction for any reason at our sole discretion. We shall not be liable to you or to any third party for the removal of any product from our website (whether sold or not), for the removal, screening or modification of any material or content on the website, or for refusing to process or for suspending any transaction after processing has begun.
2. ORDER CANCELLATION BEFORE SHIPPING
You may cancel your order only if it has not yet been packed and shipped from our warehouse. If you wish to cancel, please contact us immediately by email or telephone. We reserve the right to refuse cancellation if the order has already been packed by our warehouse.
3. PAYMENT
Payment can be made by MasterCard, Visa, PayPal or any other payment method clearly indicated on our website from time to time. Payment will be debited and cleared from your account when your order is shipped by Dioib SAS.
We take all reasonable precautions to secure our website. All credit‑card transactions on this website are processed using a secure online payment platform that encrypts your card details in a secure hosted environment. In addition, we will take all reasonable measures, to the extent within our control, to keep your order and payment details secure. However, we cannot be held liable for any loss you may suffer if a third party obtains access to any data you provided when using or ordering via the website.
4. PRICES
The price of a product displayed on the website at the time of order acceptance will be honoured, except in the case of typographical or technical errors.
All prices are shown in EURO (or another currency you may select for display) including VAT and other taxes. Any amounts displayed in currencies other than EURO are calculated based on the daily EURO exchange rate. In case of a return, the refund will be calculated according to the exchange rate on the date of the return.
All customs duties and import taxes charged once the order reaches the destination country must be paid by the recipient. Dioib SAS has no control over these fees and cannot estimate their amount. Customs policies vary significantly by country; you may contact your local customs office for information. Orders are shipped from France or China.
5. RETURNS AND RIGHT OF WITHDRAWAL
We offer a 30‑day return policy from the date of receipt of the product.
You may exercise your right of withdrawal without giving any reason by notifying us of your decision by email or post to contact@dioib.fr.
The withdrawal period begins on the day you receive the product. If the 30‑day period expires on a public holiday, on Saturday 24 December (Christmas Eve) or on 31 December (New Year’s Eve), the deadline is extended to the next business day. The deadline is considered respected if you send your withdrawal notification before the expiry of the period.
If you exercise your right of withdrawal, you must return the product to us no later than 14 (fourteen) days after you notified us of your decision to cancel the purchase.
Return address:
Dioib SAS - 7 rue Saint-Claude
75003 PARIS
FRANCE
The right of withdrawal cannot be exercised simply by refusing delivery, by failing to collect the product from the carrier, or by returning the product to our distributors.
Proof that the product was shipped before expiry of the 14‑day period may be requested. You bear the risk of the product during transport and are responsible for ensuring that the parcel / product arrives in good condition. Accordingly, you must keep postal receipts and any tracking number. We encourage you to include a copy of the order confirmation or any other document relating to the purchase and to return the product in its original packaging.
Products must be returned in good condition, undamaged, and in their original packaging. If returned products show signs of damage or use beyond what is necessary to establish the nature, characteristics and functioning of the product, you will be liable for any loss in value of these products. You may thereby lose all or part of your refund. We will assess value on the basis of a specific assessment of the returned product. Refunds will be issued once we have received and accepted the returned items. Refunds will be credited to the credit card originally used for purchase, less any applicable import duties or taxes. We will reimburse the purchase price and original shipping cost (but not any premium shipping cost you selected above standard shipping).
Return shipping costs are your responsibility and not covered by Dioib SAS. Please note that Dioib SAS does not offer item exchanges. If you wish to exchange your purchase for a different size, colour or style, you must follow the return procedure and place a new order.
6. DEFECTS / LEGAL WARRANTY
When you purchase a product from our online store, you benefit from a legal right of claim (warranty) of two years from the date of delivery. This means that up to two years after delivery you may obtain a replacement product, a refund or a reduction in the purchase price if the product is defective and under applicable law.
Damage caused by accidents, misuse, incorrect use, abuse or any other wrongful conduct is not covered by the warranty.
If you encounter a damaged or defective item, please contact us in a reasonable time by email at administration@dioib.fr. If the claim is justified and made in time, the price of the merchandise will be refunded. This applies only if you purchased the product from https://f360a4‑4.myshopify.com.
If your complaint is filed within two months of its detection, it will be considered timely. Your claim must be filed no later than two years from the date of delivery.
When returning the product, ensure you have the postal receipt stamped and signed at the post office as proof of return. Keep the receipt until you receive confirmation from Dioib SAS that your returned parcel has been received and processed.
